MOCKINGBIRD MOBILE HOME PARK RULES AND REGULATIONS

 

1.        All rents are due in advance, on or before the first of any month.  In order to protect our office staff, NO CASH is accepted for payments.  Please pay with a personal check, cashier’s check, or money order.    Rent and water/waste water charges are due the 1st of the month, and are late after the 3rd. If the water/waste water charges, along with rent and any other charges are not paid by the 3rd, the water services will be disconnected.  Reconnection of services will be made after payments of all charges due are paid, and a reconnect fee is paid.  Reconnect fees are such: $25.00 paid before 4PM for same day service during normal Posted Lessor Office Hours.  Fees paid after 4PM, and/or service requested for office hours not herein defined as “Normal” will be $50.00.  If the rent or other sums payable hereunder are not paid within 3 [three] days of the date on which such are due, a late charge of $ 35.00 plus $ 5.00  per day thereafter will be added to the amount due. Additionally, a charge of $35.00  will be made for all checks returned due to insufficient funds or for any other reason

2.         Speed limit in the park is TEN (10) miles per hour.

3.        No storage on patios or lot except in APPROVED storage shed.

4.        All connections to utility meters, sewer and water outlets are to be at the expense of the Tenant.  Tenant agrees not to dispose of large amounts of tissue, sanitary napkins, diapers, or other large items or grease in the sink or toilet.   Tenant agrees to pay for any sewer problems caused by such abuse.

5.       All propane tanks must be 250 gallons - NO CANISTERS ARE ALLOWED.

6.        Tenant shall keep premises clean and orderly, free of trash and debris at all times.  Tenant shall mow and trim the lawn as often as necessary to maintain the premises.  Should Tenant fail to do so, Park Management will perform said maintenance and add the cost to the rental.  Cost for this maintenance shall be set by Park Management.

7.        The only acceptable clothesline is an umbrella type.

8.        Lessee, family and guests will not make loud noises (music etc.) or otherwise disturb the peace and quiet of the premises in any manner after 11:00 p.m. Sunday through Thursday nights or after 12:00 p.m. on Friday and Saturday nights.

8.1.      San Marcos City Code Sec. 54.078 Curfew offense

8.1.1.    A minor commits an offense if the minor remains in any public place within the city limits during curfew hours.

8.1.2.    A parent of a minor commits an offense if the parent knowingly permits, or by insufficient control, allows the minor to remain in any public place within the city during curfew hours.

9.        Written plans, and an estimated completion date, for decks, masonry work, or any other type of improvements or changes to lot, must be SUBMITTED IN WRITING PRIOR TO BEGINNING WORK.

10.     Tenant may have guests for a reasonable period of time. However, permanent occupancy is restricted to one family per mobile home.

11.     No mobile home or lot shall be subleased or rented without the PRIOR WRITTEN APPROVAL FROM PARK MANAGEMENT.

12.     No parking on the street at any time.  If you are having more guests than your parking space allows, they or you may park on a vacant lot close to you.  No major repair of cars or other vehicles in park is permitted.  Any unregistered or in-operable vehicle is not permitted in the park and will be towed away at the owner's expense (Tenant).  NO LARGE CAPACITY TRUCKS ARE PERMITTED, (except for park maintenance).  Motorcycles are to be parked in driveways, not yards or on patios. VEHICLES IN VIOLATION WILL BE TOWED AT TENANT'S EXPENSE.

13.      PARK MANAGEMENT MUST BE ADVISED IN WRITING PRIOR TO GETTING AN  INSIDE OR OUTSIDE CAT OR DOG.

13.1.    Upon Management acceptance of pet[s] a $200.00 pet deposit is required for each pet.

13.2.    All tenants with dogs are required to have a professionally installed chain fence.  Tenant may have two (2) dogs if both are under thirty (30) pounds, or one (1) dog over thirty pounds.  When walking pets, they must be on a leash.  Loose pets will result in a FINE OF TWENTY DOLLARS ($20.00) per animal and violation.

13.3.    Tenants found to be keeping pets without Management approval shall be required to post a $400.00 deposit per pet or face immediate eviction.

14.     Socially unacceptable conduct by Tenant, and/or members of his/her family or guest(s), is strictly prohibited.  NO   DISCHARGE OF FIREARMS OR FIREWORKS.

15.     Mobile homes must be tied down upon moving on lot and skirted with Vinyl skirting with-in 30 days of move-in.   No wood skirting is allowed.

16.     TRASH DISPOSAL...  Dumpsters are provided in designated areas.  They are for household garbage only.  DO NOT PUT BOXES, FURNITURE, MATTRESSES, BRANCHES, ETC. IN THE DUMPSTERS.  USE TRASH BAGS, NOT BOXES, FOR DISCARDING TRASH, AS BOXES DO NOT COMPACT LIKE BAGS.  Boxes must be broken down flat. Do not allow small children to take out your trash.  There is a twenty dollar ($20.00) fine for garbage dumped outside the dumpster, NO EXCEPTIONS.

17.     Residents and their children and guests are to remain on their lots when playing or in designated common area.  No cutting through yards to get to another house.  PARENTS ARE RESPONSIBLE FOR THEIR CHILDREN'S BEHAVIOR.

18.     Should your children be seen violating park rules or found damaging any property park management has the option to allow the parent to pay for damages and or will file and evict responsible family from the park. 

 

PARK MANAGEMENT SHALL NOT BE LIABLE FOR ANY DAMAGE, LOSS, OR INJURY TO TENANT, HIS/HER FAMILY, GUESTS, OR PROPERTY WITHIN THE MOBILE HOME PARK.
